GENERAL PROVISIONS
These Terms and Conditions govern the business relationship between Melina Digital and users of its services, as well as purchasers of digital products and online educational programmes.

Melina Digital is registered to provide services in the fields of digital marketing, design, photography, video, public relations and other registered business activities.
By using the services, ordering a service or purchasing a digital product or online educational programme, the user confirms that they have read and understood these Terms and Conditions.
SERVICES AND DIGITAL PRODUCTS
Melina Digital provides services in digital marketing, branding, marketing strategy, web and graphic design, digital content creation, photography, video production and editing, newsletter creation, individual consultations and education, as well as other services within its registered business activities.
Melina Digital also sells digital products and online educational programmes which, following successful purchase, are made available to the customer electronically.
The detailed content, scope, price and conditions applicable to an individual service or digital product are specified on the relevant sales page, quotation or service price list.
By ordering a service or purchasing a digital product or online educational programme, the user confirms that they have read and understood these Terms and Conditions.
PRICES
All prices are expressed in euros (EUR).
Melina Digital is not registered for VAT. VAT is not charged pursuant to Article 90 of the Croatian Value Added Tax Act.
Current service prices are available in the price list published on the Melina Digital website.
The price applicable to an individual purchase is the price displayed to the customer at the time the order or purchase is made.
ORDERING AND CONCLUSION OF CONTRACT
Services may be ordered by e-mail, direct agreement or through other available means of communication.
Digital products and online educational programmes are purchased through the relevant sales page and online purchasing system.
Before completing an online purchase, the customer is provided with essential information about the product or educational programme, the price and the available payment options.
Following successful completion of the purchase, the customer receives confirmation and/or the information required to access the purchased content at the e-mail address provided during the purchase process.
PAYMENT AND INVOICING
Payment for services is made by cashless bank transfer in accordance with the issued invoice or quotation.
Payment for digital products and online educational programmes purchased through the website is made electronically using the payment methods made available to the customer during the purchasing process.
Following successful payment, an invoice is issued electronically and sent to the e-mail address provided by the customer during the purchase process.
Invoices are issued and fiscalised in accordance with the applicable laws and regulations of the Republic of Croatia.
DELIVERY OF DIGITAL PRODUCTS AND ONLINE EDUCATIONAL PROGRAMMES
Digital products and access to online educational programmes are delivered electronically.
Following successful purchase, the customer receives a link, access credentials or other information required to access and use the purchased content at the e-mail address provided during the purchase process.
The customer is responsible for ensuring that the e-mail address and other information entered during the purchase process are accurate.
If the customer does not receive access to the purchased content due to technical difficulties, they may contact Melina Digital at mj@melina-digital.com.
RIGHT OF WITHDRAWAL
In the case of a distance contract, a consumer generally has the right to withdraw from the contract within 14 days without giving any reason, in accordance with the Croatian Consumer Protection Act.
In the case of digital content that is not supplied on a tangible medium, the right of withdrawal may be lost once the supply of the digital content has begun, provided that the consumer has given prior express consent for performance of the contract to begin before the expiry of the withdrawal period, has acknowledged that they thereby lose their right of withdrawal, and the trader has provided the consumer with the appropriate confirmation of the concluded contract.
If these statutory conditions have not been met, the consumer's right of withdrawal applies in accordance with the Croatian Consumer Protection Act.
For products and services for which a right of withdrawal exists, consumers will be provided with a means of exercising that right in accordance with applicable law.
In cases where the consumer has the right to withdraw from the contract, a withdrawal request may be submitted using the
“Contract Withdrawal”
function available on the Melina Digital website.
After submitting the request, the consumer will receive confirmation of receipt of the withdrawal statement without undue delay at the e-mail address provided by the consumer. The confirmation will include the content of the withdrawal statement and the date and time of its submission.
ADDITIONAL MONEY-BACK GUARANTEE
Without prejudice to the consumer's statutory rights, Melina Digital provides purchasers of the DIY MARKETING with Melina online course with an additional voluntary 14-day money-back guarantee, subject to the conditions set out below.
If, within this period, the customer determines that the course does not meet their expectations, they may request a refund of the amount paid, provided that they have viewed no more than 20% of the total course content.
If the customer has viewed more than 20% of the course content, a refund under this voluntary guarantee is available only if, within the stated period, the customer has completed all tasks required in the workbook and has documented the implementation of the instructions and tasks included in the programme.
The completed workbook and evidence of completion and implementation of the tasks must be submitted together with the refund request.
Simply viewing or completing the entire course without completing and documenting the implementation of the required tasks does not entitle the customer to a refund under this additional guarantee.
A refund request under this additional guarantee must be submitted no later than 14 days from the date of purchase.
This voluntary guarantee does not limit or exclude any statutory consumer rights arising under the applicable laws and regulations of the Republic of Croatia.
CONSUMER COMPLAINTS
In accordance with Article 10 of the Croatian Consumer Protection Act, consumers may submit a written complaint electronically to:

Receipt of a written complaint will be acknowledged without undue delay.
Melina Digital will respond to a written complaint in writing no later than 15 days from the date on which the complaint was received, clearly stating whether the complaint is considered justified.
Records of written complaints will be retained on a durable medium for the period prescribed by law.
LIABILITY FOR DIGITAL CONTENT AND DIGITAL SERVICES
Melina Digital is responsible for the conformity of the supplied digital content or digital service with the contract in accordance with applicable consumer protection legislation.
In the event of difficulties accessing or using purchased digital content, the customer may contact Melina Digital at mj@melina-digital.com.
COPYRIGHT AND USE OF CONTENT
Online educational content, video lessons, texts, photographs, graphic materials, templates, work materials, PDF documents and other digital content created by Melina Digital are protected by copyright, unless expressly stated otherwise.
By purchasing a digital product or online educational programme, the customer acquires the right to use the content for their own personal purposes, within the scope specified for the individual product.
Unauthorised reproduction, distribution, resale, public publication, sharing of access credentials or granting third parties access to purchased content is prohibited unless expressly stated otherwise for a particular product.
PERSONAL DATA PROTECTION
Personal data of users and customers is processed in accordance with applicable personal data protection legislation and the Privacy Policy published on the Melina Digital website.
Data required to complete a purchase, issue an invoice, provide access to digital content and communicate with the customer is processed for the purposes of performing the contractual relationship and complying with legal obligations.

CHANGES TO THE TERMS AND CONDITIONS
Melina Digital reserves the right to amend these Terms and Conditions in order to reflect changes in its business operations or applicable laws and regulations.
Each purchase is governed by the Terms and Conditions that were in force and available to the customer at the time the contract was concluded.
FINAL PROVISIONS
The relationship between Melina Digital and its users or customers is governed by the applicable laws of the Republic of Croatia.
For matters not specifically regulated by these Terms and Conditions, the relevant provisions of the Croatian Consumer Protection Act, the Croatian Civil Obligations Act, the Croatian Electronic Commerce Act and other applicable laws and regulations of the Republic of Croatia shall apply.
